Execution and Asset Investigation Services

Asset Investigation and Enforcement Process Nationwide

  • 1. Request the court to issue an order appointing an enforcement officer to seize or attach the debtor’s assets in the first instance.
  • 2. Investigate the debtor’s assets by searching the land office in the area near the debtor’s residence.
  • 3. Once the debtor’s assets are located, a seizure order will be filed with the Department of Enforcement to await the auction.
  • 4. Once the seizure is made, the auction proceeds will be entered into. Upon successful sale, the debtor will receive the proceeds from the auction to the creditor.

Seizure Procedure

Once the court has issued a judgment and issued a decree to the defendant, and the defendant fails to comply with the decree, the plaintiff must issue a writ of execution to seize the defendant’s property. Once the writ of execution is sent to the Department of Legal Execution, the plaintiff must file a complaint with the enforcement officer. The Department of Legal Execution divides the seizure into two types: seizure and attachment.

Seizures include seizure of land, houses, buildings, cars, shares, and movable property. Etc. –

Seizures include seizure of bank deposits, salaries (in the case of private companies and state enterprises), and claims from outside parties.

Evidence that must be submitted to the enforcement officer when filing a case.

1. Power of Attorney for Asset Seizure (Use the Department of Enforcement form.)

2. National ID card, company certificate of the grantor and grantee (in the case where the plaintiff is a company)

3. Evidence of the defendant’s status, company certificate, house registration document

4. Evidence of the defendant’s ownership, such as land title deed, sales contract, mortgage contract, condominium ownership document, house registration, vehicle registration manual, share certificate, etc.

In the case of bank deposit seizure, such as bank account number, account type, bank name, salary seizure, such as name of workplace, salary rate, The amount requested for seizure, attachment of rights, or claims, such as lease agreements, leasehold rights, usufruct, compensation, or indemnity, must contain sufficient information and documents for the enforcement officer to issue a correct and complete warrant. This information must be thoroughly investigated before the action can be taken.

In the case of real estate, additional evidence must be submitted on the seizure date, namely:

2. Travel map to the location of the seized property.

3. Current photograph of the seized property.

4. Land and condominium appraisal value certified by the official.

5. Auction fee of 2,000 baht.

6. List of neighboring land owners in the four directions.
