Applying for a work permit

A work permit refers to a foreigner who must travel to work in Thailand to engage in business, enterprise, or employment. All occupations are required to apply for a visa type change. According to the law of the Kingdom of Thailand, foreigners traveling to work in Thailand must apply for a visa type change to a Non-Immigrant Visa “B” or a business visa. Once the visa change has been completed, they must apply for a work permit or work permit. Otherwise, they will not be able to work in the Kingdom of Thailand.

            When a foreigner applies for a visa If you have received a Non-Immigrant Visa “B” but have not yet applied for a work permit, you can apply in person at the Department of Employment, Ministry of Labor, within 90 days after arrival in Thailand. Under the law, you are permitted to temporarily reside in the Kingdom.

Applying for a work permit for the first time or when the previous permit has expired and you are applying for a new one. Qualifications for foreigners applying for a work permit

1. Foreigners residing in the Kingdom or temporarily entering the Kingdom under the Immigration Act (NON-IMMIGRANT) and not as tourists or transit travelers (TOURIST/TRANSIT), who will be granted work permits for the first time. Or if the original permit has expired, a new permit is requested.

2. Have the knowledge and ability to perform the work for which the permit is requested.

3. Not be a mentally unstable or mentally unstable person. Not suffering from leprosy, late-stage tuberculosis, elephantiasis in a stage that is socially distasteful, serious drug addiction, chronic alcoholism, or tertiary syphilis.

4. Never been imprisoned for an offense under the Immigration Act. Or the Alien Employment Act within 1 year prior to the permit application date.

   Documents required for applying for a work permit are as follows:

   1. Application form TM.1 and three 3×4 cm (1.5 inch) photographs (taken within the last 6 months and not computer/Polaroid photos)

   2. Letter to the Provincial Governor explaining the necessity of hiring foreign workers If the company has been approved by the Board of Investment (BOI) or the Industrial Estate Authority of Thailand (IEAT), please submit a letter to the provincial governor explaining the reasons for not applying for the B.O.I or the IEAT promotion, along with a copy of the promotion certificate.

   3. Employment certificate or employment contract.

   4. Copy of educational and employment records.

   5. Medical certificate.

   6. Copy of passport or residence certificate and alien identification card, along with the originals.

   7. Copy of professional license, if the law requires a professional license.

   8. Power of attorney from the employer (if the employer is a foreigner, a copy of the work permit is required) ) Affix a 10 baht stamp duty and a copy of the attorney’s ID card.

 Documents to be considered according to the type of business/employer

   1. Private establishments

       1.1 A copy of the Thai juristic person registration certificate and a copy of the shareholder list (not older than 6 months). For foreign juristic persons, a copy of the foreign business license issued in accordance with the Foreign Business Act B.E. 1999, along with evidence of bringing foreign funds into the country for spending.

       1.2 A copy of the Value Added Tax registration (Por Por. 01 and Por Por. 20) indicating the type of business, and Por Por. 09 (if any changes).

       1.3 In the case of a foreign employer, attach a copy of the employer’s work permit if the employer does not work in Thailand. If you do not have a work permit, a notary public and the Thai embassy must certify the power of attorney authorizing a director or individual to sign on your behalf.

       1.4 In the case of employers operating businesses that require permission under other laws or require a business operation permit from a relevant government agency, such as a factory operation permit, hotel operation permit, Food and Drug Administration permit, travel agency permit, or permit to use the premises as a food vendor.etc.

      1.5 List of foreign workers, including work permit numbers, located in the establishment, work division chart, and establishment location map.

      1.6 Copy of proof of social security payments for the most recent month and copies of current income documents, including financial statements and Form Por Ngor Dor 50 or Form Por Ngor Dor 51 (latest year). and Form Por. 30

      1.7 4 photos of the business premises, 1 photo of the company sign, 1 photo of the front of the building, 2 photos of the interior (2 photos inside the factory), if available.

   2. Private School / Private University

      2.1  Copy of the appointment letter for teachers or instructors (instructors responsible for teaching) With employment contract / Private universities must present a Ministry of Education affiliation certificate stating the alien’s name, position, and employment period.

      2.2 Teacher’s license (according to the Teachers and Educational Personnel Council Act), excluding trainee teaching positions, or a teacher’s license deferral form.

      2.3 Copies of the school establishment license, principal license, and manager license. / Various licenses (if any) / Copies of the university establishment certificate and the appointment order of the university’s authorized signatory.

      2.4 Educational qualification documents/Teaching transcripts and documents proving teaching experience (if any)

   3. Government agencies

     3.1 A certificate from a government agency / state enterprise / public organization / educational district (in the case of government school teachers) stating the name, position, and duration of employment.

     3.2 In the case of government school teachers, please present a teaching license (in accordance with the Teachers’ Council and Educational Personnel Act), except for the position of trainee teacher.

   4. Foundation or Association

       Certificate of Incorporation of Foundation or Association, Objectives, and List of Board Members

   5. Foreign Filming or Film Production Business 

     5.1 Certificate from the Tourism Development Office, Coordinator License Complete with a list of names, job positions, and passport numbers of the alien.

     5.2 A copy of the certificate of incorporation and a copy of the shareholder list (not older than 6 months).
